Please read these Terms of Service carefully before using journeymhw.com or purchasing any services from Journey Mental Health & Wellness PLLC. By accessing our website or using our services, you agree to be bound by these terms.
1. ABOUT US
Journey Mental Health & Wellness PLLC ("Journey MHW," "we," "us," or "our") is a virtual psychiatric practice owned and operated by Christopher James Spitale, PMHNP-BC, licensed in Texas and Colorado. We provide telehealth medication management services for ADHD, generalized anxiety disorder (GAD), and major depressive disorder (MDD) to patients physically located in Texas and Colorado.
2. ACCEPTANCE OF TERMS
By visiting journeymhw.com, booking an appointment, or purchasing any service, you confirm that you:
- Are at least 18 years of age, or are a parent or legal guardian of a patient aged 13–17
- Have read, understood, and agree to these Terms of Service
- Have read and agree to our Privacy Policy
- Are physically located in Texas or Colorado at the time of any telehealth appointment
3. SERVICES
Journey Mental Health & Wellness PLLC provides virtual psychiatric medication management services via telehealth. Our services include:
- Initial psychiatric evaluations
- Ongoing medication management for ADHD, anxiety, and depression
- Follow-up appointments and prescription management
- ADHD cognitive testing via Creyos
- Secure messaging for clinical questions between visits
Our services are available only to patients physically located in Texas or Colorado at the time of their appointment. We do not provide services to patients in other states.
Not an Emergency Service: Our services are not appropriate for psychiatric emergencies. If you or someone else is in immediate danger, call 911. If you are experiencing a mental health crisis or having thoughts of self-harm, call or text 988 (Suicide & Crisis Lifeline) immediately.
4. ELIGIBILITY
To receive services from Journey Mental Health & Wellness PLLC, you must:
- Be 13 years of age or older (patients under 18 require parental or guardian consent)
- Be physically located in Texas or Colorado at the time of your appointment
- Have a valid government-issued photo ID
- Complete all required intake forms and consent documents prior to your first appointment
5. APPOINTMENTS AND CANCELLATIONS
Booking: Appointments are booked through our SimplePractice scheduling portal at christopher-spitale6207.clientsecure.me.
Cancellation Policy:
- Cancellations made less than 24 hours before your scheduled appointment are subject to a $100 late cancellation fee
- No-call, no-show appointments are subject to a $150 fee
- Fees are charged to the payment method on file
Rescheduling: We encourage patients to reschedule rather than cancel whenever possible. Please contact us as soon as possible if you need to make changes to your appointment.
6. FEES AND PAYMENT
Self-Pay Rates:
- Initial evaluation: $175
- Follow-up visits: $100
- Annual Care Plan: $720/year
Insurance: We accept Cigna, Blue Cross Blue Shield (BCBS), Aetna, and many of their subsidiaries. Insurance coverage and patient responsibility vary by plan. Patients are responsible for any amounts not covered by insurance, including copays, deductibles, and coinsurance.
Annual Care Plan: The Annual Care Plan is a prepaid, all-inclusive care package. By purchasing the Annual Care Plan, you agree to the terms outlined on the product page, including the services included and payment terms. The Annual Care Plan is non-refundable once services have commenced.
Financing: Flexible payment options are available through Affirm and Shop Pay. Financing terms are subject to approval by the respective financing provider. Journey MHW is not responsible for financing decisions made by third-party providers.
Late Fees: Unpaid balances may be subject to collection procedures.
7. TELEHEALTH CONSENT
By booking a telehealth appointment with Journey Mental Health & Wellness PLLC, you acknowledge that:
- Telehealth services are provided via SimplePractice's HIPAA-compliant video platform
- You have a private, secure location available for your appointment
- You understand the limitations of telehealth compared to in-person care
- You have completed and signed our telehealth informed consent form prior to your first appointment
- You are physically located in a state where our provider is licensed (Texas or Colorado) at the time of your visit
8. PRESCRIBING POLICY
Journey Mental Health & Wellness PLLC prescribes medications as part of our medication management services. By receiving prescriptions from our practice, you agree to:
- Use prescribed medications only as directed
- Disclose all current medications, supplements, and substances to your provider
- Not share, sell, or transfer prescribed medications to any other person
- Comply with the terms of our Controlled Substance Agreement, signed at intake
- Notify your provider of any side effects or concerns
Prescriptions are sent electronically to your pharmacy of choice via DrFirst. We do not provide paper prescriptions or call-in prescriptions for controlled substances.
Early Refills: Early refill requests are evaluated on a case-by-case basis. Medications reported as lost or stolen require a police report before an early replacement prescription will be issued.
9. PATIENT RESPONSIBILITIES
As a patient of Journey Mental Health & Wellness PLLC, you agree to:
- Provide accurate and complete information at all times
- Attend scheduled appointments or provide timely notice of cancellation
- Treat our provider and staff with respect
- Complete required assessments and testing as requested (including Creyos ADHD testing where applicable)
- Notify us immediately if your location changes to a state where we are not licensed
- Follow your treatment plan and communicate concerns promptly
10. LIMITATIONS OF SERVICES
Our services are limited to medication management and do not include:
- Primary care services
- Emergency psychiatric care
- Inpatient or residential treatment
- Court-ordered evaluations or forensic psychiatry
- Disability evaluations or documentation for legal proceedings
If you require services beyond our scope, we will make every effort to provide appropriate referrals.
11. TERMINATION OF SERVICES
Journey Mental Health & Wellness PLLC reserves the right to discontinue services to any patient at our sole discretion, including but not limited to cases involving:
- Violation of these Terms of Service or our Controlled Substance Agreement
- Threatening, abusive, or disrespectful behavior toward staff
- Suspected diversion, misuse, or fraud related to controlled substances
- Non-compliance with treatment recommendations
- Repeated no-shows or late cancellations
In non-emergency situations, we will provide reasonable notice and assistance with transition of care.
12. INTELLECTUAL PROPERTY
All content on journeymhw.com, including text, graphics, logos, and images, is the property of Journey Mental Health & Wellness PLLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from our website without our express written permission.
13. DISCLAIMER OF WARRANTIES
Our website and services are provided "as is" without warranties of any kind, express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific clinical outcomes from our services.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Journey Mental Health & Wellness PLLC, its owner, and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability to you for any claim shall not exceed the amount you paid for services in the three months preceding the claim.
15. INDEMNIFICATION
You agree to indemnify and hold harmless Journey Mental Health & Wellness PLLC, its owner, and its affiliates from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms of Service or your use of our services.
16. GOVERNING LAW
These Terms of Service are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Collin County, Texas.
17. CHANGES TO THESE TERMS
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
